Unless and until this agreement is cancelled in accordance with the terms hereof, the Member hereby authorizes M33 and M33’s billing service, CCBill, to charge Member's credit card or other approved way of payment) to pay for the cost of membership. Payment for a monthly full membership may be made by automatic credit card debit. At the end of each month, for members who have taken Silver membership if a Member does not cancel their membership, it will be automatically renewed for another month (at the £14.95 rate.). And this will continue until the member cancels their membership. Membership of M33 may be terminated at anytime and without cause, by either M33 or the Member. When termination is requested by a Member, membership fees for that and all prior months are not refunded. Members are liable for charges incurred until they terminate their membership.

Until our billing agent is notified (by calling 1-888-596-9279 or emailing consumersupport@ccbill.com) of a breach in security, the Member will remain liable for any unauthorized use of M33 material.
Members are responsible for providing all personal computer and communications equipment necessary to gain access to M33 membership.
Access to M33 membership is through a combination of an ID and a password. Each Member must keep their password strictly confidential. Remember your password. For security reasons, M33 will not release passwords for any reason, except as may be specifically required by law or court order. Unauthorized access to M33 membership is a breach of this Agreement and a violation of law.
The material on M33 website is for the use of Members only. Any other use is prohibited. Members may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any images or video clips (or parts thereof) obtained from M33 website.
Except for public domain material, all material displayed on M33 website is copyrighted and licensed and may not be copied, redistributed, or downloaded, in whole or in part, without the prior written consent of M33.
M33 forums will enable Members to contact and share information with other Members. Members agree not to submit, publish, or display in the forums any defamatory, inaccurate, abusive, threatening, racially offensive, homophobic, transphobic, or illegal material. Transmission of any material that violates any federal, state, or local law, is prohibited and is a breach of this Agreement.
Notices by M33 to Members may be given by means by a general posting on Member homepages or by electronic or conventional mail. Communications by Members to M33 may be given by e-mail. (info@massage33.com)
The Member hereby swears and affirms under oath, warrants and represents that the Member is at least 18 years of age (21 in some jurisdictions) and has the legal capacity to enter into agreements of this nature. M33 makes no representation or warranty that the content published herein complies with the local laws of your jurisdiction. You are solely responsible for knowing and understanding your local laws concerning standards of content legality for the purposes of obscenity laws. You further represent that you understand that the nature of the content published herein contains sexually explicit materials, and that you choose to view the content on M33 website and that this choice is a voluntary and knowing one. Do not subscribe to M33 if you find sexually explicit material offensive or vexing or if you cannot fully agree to the terms and conditions of this Agreement.
M33 has established a Privacy Policy to explain to users how their information is collected and used, which is located at: www.massage33.com/privacy. Your use of M33 signifies acknowledgment of and agreement to our Privacy Policy.
Any liability of M33 including without limitation any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behaviour, negligence, or under any other cause or action, shall be strictly limited to the amount paid by or on behalf of the Member to M33 for the preceding 12 months. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Disclaimer of Warranties: You agree that your communication with other members is entirely your own choice. M33 forum is provided “as is” and on an “as available” basis, without any warranties of any kind. All express and implied warranties, including without limitation, the warranties of merchantability and fitness for a particular purpose are expressly disclaimed to the fullest extent permitted by law. Some jurisdictions do not allow the disclaimer of implied warranties. In such jurisdictions, some of the foregoing disclaimers may not apply to you insofar as they relate to implied warranties.
Limitations of liability: Under no circumstances shall M33 be liable for direct, indirect, incidental, special, consequential or exemplary damages (even if M33 has been advised of the possibility of such damages), resulting from any aspect of your use of M33 website, whether the damages arise from use or misuse of M33 website, from inability to use M33 website, or the interruption, suspension, modification, alteration, or temporary termination of M33 website. Such limitation shall also apply with respect to damages incurred by reason of other services or products received through or advertised in connection with M33. These limitations shall apply to the fullest extent permitted by law. In some jurisdictions, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitation may not apply to you.
Indemnity: You agree to indemnify and hold M33, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable legal fees, made by any third party due to or arising out of your use of M33 in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above. If you are a California resident, you waive California Civil Code Section 1542, which says "A general release does not extend to claims which the creditor does not know or suspect to exist in his favour at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."
Should any claim arise the Member agrees to submit to the personal jurisdiction of the courts of California. Member further agrees to mediation as the means of settling any and all disputes that arise.
This Agreement contains the entire agreement between the Member and M33 regarding the use of M33 website, and supersedes all prior written and oral understandings and writings, and may only be amended upon notice by M33 to Members. Unless otherwise explicitly stated, the provisions of this Agreement shall survive its terminations.
Your Member submissions
1 As an M33 account holder you may submit video content ("User Videos") and textual content ("User Comments") (collectively referred to as "Member submissions"). You understand that whether or not such Member submissions are published, M33 does not guarantee any confidentiality with respect to any Member submissions.
2 You retain all of your ownership rights in your Member submissions, but you are required to grant limited licence rights to M33
3 You understand and agree that you are solely responsible for your own Member submissions and the consequences of posting or publishing them. M33 does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and M33 expressly disclaims any and all liability in connection with Member submissions.
4 You represent and warrant that you have (and will continue to have during your use of the Services) all necessary licenses, rights, consents, and permissions which are required to enable M33 to use your Member submissions for the purposes of the provision of the Services by M33, and otherwise to use your Member submissions in the manner contemplated by the Website and these Terms.
Content of your Member submissions
1 You agree that your conduct on the site will comply with (and you agree that the content of all of your Member submissions shall comply with) the M33 Guidelines.
2 You agree that you will not submit any Member submissions which contain content which it is unlawful for you to possess in the country in which you are resident, or which it would be unlawful for M33 to use or possess in connection with the provision of the Services.
3 You agree that you will not submit any Member submissions that are subject to any third party proprietary rights (including rights of privacy or rights of publicity), unless you have a formal licence or permission from the rightful owner to post the material in question and to grant M33 the licence.
4 M33 reserves the right (but shall have no obligation) to decide whether Member submissions comply with the content requirements set out in these Terms and may remove such Member submissions and/or terminate a User's access for submiting any Member Submission which is in violation of these Terms at any time, without prior notice and at its sole discretion.
5 You further understand and acknowledge that in using the M33 Website and the Services, you may be exposed to Member submissions that are factually inaccurate, offensive, indecent, or otherwise objectionable to you. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against M33 with respect to any such Member submissions.
Rights you licence
1 When you submit a Member Submission to M33, you grant:
to M33, a worldwide, non-exclusive, royalty-free, transferable licence (with right to sub-licence) to use, reproduce, distribute, prepare derivative works of, display, and perform that Member Submission in connection with the provision of the Services and otherwise in connection with the provision of the Website and M33's business, including without limitation for promoting and redistributing part or all of the Website (and derivative works thereof) in any media formats and through any media channels;
to each user of the Website, a worldwide, non-exclusive, royalty-free, licence to access your Member submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such Member submissions to the extent permitted by the functionality of the Website and under these Terms.
1.2 The above licenses granted by you in Member Videos terminate when you request removal to M33 of your Member Videos from the Website. The above licenses granted by you are perpetual and irrevocable, but are otherwise without prejudice to your ownerships rights, which are retained by you.
